Notice Regarding Website Privacy Demand Letters

NJ Realtors® has learned that some real estate brokerages, Realtor® associations, and other businesses throughout the state and across the country are receiving demand letters alleging that their websites violate state privacy laws, including the California Invasion of Privacy Act (“CIPA”), because of certain online tracking technologies. These letters generally claim that website analytics or marketing tools collect visitor information without proper consent. A demand letter is not a court ruling and does not mean that anyone has done anything wrong. If you receive a demand letter, contact your attorney immediately.  

What You Can Do Now

  • Review your website to identify any analytics, advertising, or other tracking technologies that may be in use, including Google Analytics, Meta/Facebook pixels, etc. 
  • Talk to your web developer or website provider about whether your website complies with state and international privacy laws, such as the EU’s GDPR, and whether any updates are recommended.
  • Review your website's privacy policy and cookie consent practices to ensure they are current and accurately describe how visitor information is collected and used. 
  • Do not ignore a demand letter if you receive one, contact your attorney promptly to discuss your options before responding or making any changes to your website.
  • Stay informed through reliable sources such as NJ Realtors®.
