On March 10, 2015, the New Jersey State Supreme Court issued a ruling placing the courts in New Jersey in charge of affordable housing policy instead of the Council on Affordable Housing. Under the ruling — beginning in July of this year — affordable housing policies will be able to be brought before the courts because of COAH’s inability to develop third round regulations implementing affordable housing requirements. Under this ruling, New Jersey courts will now be tasked with determining whether municipalities are in compliance with the Mount Laurel ruling which created the affordable housing requirement for New Jersey. New Jersey REALTORS® will continue to monitor this process as it takes effect over the summer.
